Samsung Loses Apple Patent Case

Just my humble opinion

I think the verdict in the trial is bad for several reasons. Mostly because this gives Apple justification to continue these lawsuits. We needed a verdict that honestly flat out denied both parties any claims to money. Basically we needed to shut Apple up.

That didn't happen.

Back in 2007, Apple did the tech world a solid and released an amazing device, but it was a device far from original. They basically took the time to take a lot of great ideas that had been tried previous and fine tuned them to the user experience and in that created something where the sum was far greater than the total of the parts.

In a nutshell they vastly improved the quality of what was out there.

I think there's a distinction between copying a concept and copying exact elements/ingredients at a literal level. Taking something such as a touch screen phone but re-thinking how it should work to be actually usable is one thing. Taking elements (say, how icons on the home screen should be laid out and colored) and literally saying "That's exactly what we should do because [company] is doing [x]" isn't.

From what I read it wasn't a statement from Samsung that "oh apple's doing it so lets copy them", but "how is our product different than Apple's?"

then some engineer noted that they should do "these changes" based off their findings.

Besides....the icons you're saying that Samsung copied look nothing like Apple's icons.

Wost case scenario, all Samsung did was pull a Steve Jobs, screwing over Apple the same way Apple screwed over Xerox to create the Mac....hey...Jobs was a believer in Karma, wasn't he? This is Karma in action...

I've posted on why this is wrong a billion times. Either you keep forgetting it, or....

1) Xerox invited Steve Jobs and the Mac team to PARC.
2) Xerox viewed it as a dead end technology and had no intentions to bring it to market
3) Xerox was given Apple stock for their usage.
4) Apple developed heavily on the PARC language.

Actually Xerox was only given stock when they sued Apple. Apple had no plans on giving any compensation until the lawsuit, so they were caught with their hands in the cookie jar and settled quickly to hush it up.

No. That is not true.

Xerox was given Pre-IPO stock back in the 80's (it was negotiated back and forth) for Apple in exchange for letting them visit PARC and sending an engineer back and forth to help Apple with it.

The lawsuit Xerox filed in 1989 was Xerox patent trolling after their own Alto successors failed and they prematurely cashed in their Apple stock. (most of it was ruled invalid.)

The stock options were given only after Xerox sued for copyright infringement....that's called a 'settlement'....

And before he became a patent troll, Steve Jobs used to publicly brag about his theft of Xerox tech, saying that 'good artists imitate, great artists steal, and I am a great artist'

Also, regarding the Picasso quote, Apple very much did 'steal' Xerox's innovation in the artistic sense- they saw a lot of potential and better execution than someone else's idea. Samsung did not 'steal' in the art...
