Why would they lie about that?
They probably didn't even think about the aspect ratio when rating the camera - OR, the actual camera mechanism itself IS capable of 5 MP, but the software limitation that forces shots into that aspect ratio limit resolution, and therefor the number of pixels in the picture.
You should give them the benifit of the doubt. I doubt they misadvertised on purpose, especially in a country where anybody can sue anybody for anything, and usually do.

I'm betting they used a 5MP sensor which usually has a 4:3 aspect ratio, coupled with software that takes 16:9 pictures. Result: ~4MP photos.
