How does the app differentiate between someone driving, and someone who's just in the passenger seat? That's the problem any app like this will run into.

I think that would really be up to the driver, to do the ethical and morally right thing. It's been proven that texting while driving makes you as bad or worse of a driver than somebody who is drunk.

Well thats just it, I can't limiters being law for reasons, not everyone in a car is driving passengers should be able to use their phones etc... Same as if you were in a bus or a train. I don't buy into social engineering for this.

You could install an NFC tag in the passenger seat or in the passenger door that allows the device to be swiped, and disable any "vehicle safety mode" service that is on the device, and make it a federal offense for it to be used if there is no passenger in the car, or make it an aggravating factor if there is a crash.
