Actually they would. There are several reasons. Let's say if Ford knows that the Mercedes is going to sell well. there are some people who are on the fence about buying either a Ford or a Mercedes or perhaps some other third party car. Let's say Dodge. Dodge is not a threat to Ford. Ford blocks Mercedes, now the people on the fence don't have Mercedes as an option, they buy Ford. Some people go to Dodge. However in this case Ford is blocking both the C-Class and the E-Class Mercedes. Now let's add in the factor that a big sales period is coming up. I.e the holidays. Ford blocks Mercedes while a 'trial' goes on. Meanwhile Mercedes has to stop all sales, all imports, and put off all advertising, because if Mercedes loses they can't sale the device and thus wouldn't waste money advertising a product they may not be able to really sale. That means people will lose interest and move on. Even if Ford eventually loses the overall court decision they have delayed Mercedes to the market and thus cost Mercedes untold amounts of sales.
Apple delays Samsung until the new Microsoft Surface/WP8 come out. Samsung is at least likely to lose some customers who would have purchased their tablet or their phone because of this. There reasoning behind filing for an injunction even if they lose Apple has caused damage to Samsung. And even the bond they put up may only cover part of the total loses and lawyer fees etc.
