That is a very good point. The only flaw is that if enough people testify that they were told by verizon or motorola that there would be a "fix", then they could argue that verizon offered false promises to keep customers from returning the equipment and cancelling. That's how I would argue it, but I'm not saying the argument would prevail. We will see how good the lawyers are.
