Yeah, but who? The ITC would be about the only body that could and they won't because they would need judicial backing. The judiciary won't do it, no matter how tired they are of frivolous court actions clogging their dockets, because of the possible appearance of impropriety. The problem really becomes either broad stroke patents and/or liberal interpretation of the patents in question. Ultimately, it comes back down to what I said before. Apple is afraid to compete in the marketplace and is throwing up any obstacles they can find to delay new devices from coming to market before the iPhone 5 can be finished and released.
