The spectrum was never intended for terrestrial broadcast use.
LS asked the FCC to grant an exception to the use rules for this spectrum and it was granted IF AND ONLY IF they could prove terrestrial broadcasts on this spectrum would not interfere with GPS systems.
They could not.
LS rolled the dice -- they came up snake eyes --
It isn't incumbent on the FCC to offer or do anything for LS.
If we want to get away from facts, and into speculation, knowing the rep and pasts 'deals' of Falcone, I'd bet money that he thought he would grease enough palms to make it happen and the FCC actually did what it was supposed to do, prevent one companies broadcasts from bleeding over anothers.
The slice of spectrum has been off limits to terrestrial broadcasts for a long time and the FCC only granted a conditional use and LS could not meet the conditions.
