I'm not sure I get this

Are they saying Nokia knowingly lied? If a company just makes some bad calls, is that actionable? Investing involves risk. They invested in a company that's had a shrinking market share for some time that is banking on platform that's been lagging behind the market, as well.

Of course it is not actionable. Any court in the country that doesn't laugh this away needs to be under review. If this were to hold up under judicial scrutiny, it would lead to more lawsuits where investors making poor choices would sue the companies that they own. Investment is a risk, and companies can project whatever they want. It does not make the company legally liable for damages if their projections don't pan out.

Yep, this is crazy. However, their investment panning out will not be fully realized for at least another six to eight months. Nokia's 900 series has been selling pretty well, just not well enough to cover the loses they already had. I believe that they will recover more and be in a better position of Microsoft's OS, once Windows 8 and WP8 are released on the fall. Higher spec phones along with Nokia tablets will boost profits. By then, the Windows Phone brand will have had much more time to gather more consumer awareness, due to the increased advertising.

Verizon already stated that they will fully support WP and I'm sure other carriers will support them as well. That has been the real reason WP7 never really took off, in my opinion.
