New York State Sues Sprint Over Tax Fraud

The big question is....

Sprint has an entire department dedicated to correcting billing and tax issues where customers relocate and do not update their address. I have to wonder if some of those unpaid taxes are due to customers moving to New York and not updating their addresses. Without current information, custoemrs would continue to be billed for the address in the system.

That would be tax-dodging on the people's fault. If the person REPORTS to Spritn that they live in say....Florida, then that's what they go by even if the person lives in NY. With eBilling, it's hard to confirm that because the billing address is set, but customer getting an email bill in NY even if addressed in Florida.

Also, there's split addressing, where the customer reports they living in one state and have their bill sent to another.

My point exactly. To bring the point on further. If a customer calls in to complain about taxes from another area on their bill, an assessment is completed. If the custoemr has overpaid based on the different areas, usually a credit is issued for up to the last 24 months. If the customer has underpaid, no action is taken. They do not collect taxes on underpayment. Thhe underpayment for reported disputes shouldn't reflect on tax roles, but I'm not sure how NY state is determining the amount of underpayment or any documentation they have in the matter.

On mobile phones based on the phone number, not the address where the customer lives? So if a person moves to New York from another state, and doesn't change to a New York number, I don't think they are supposed to be charged New York taxes. I'm pretty sure I'm still being charged Florida taxes on my mobile bill because I have a Florida phone number even though I left Florida in August 2009.

No. For Sprint, the taxes are based on the user address on the account. The market of the phone number is irrelevant. Every account I touch, I verify the billing address (where the mail goes) and the user address (where the phone is used) to make sure they are accurate. The primary location of use is what determines the tax rate for the lines of service on the account.

I don't think something like that can differ by carrier, it has to be governed by federal/and or state law....

And I am still paying Florida taxes on my mobile bill despite not living in Florida for nearly 3 years now....

I really don't think someone would cheat taxes on a wireless bill, really, what does it amount to, a few bucks per month, regardless of state, really!

All I can tell you is what Sprint policy is. You may want to check with your carrier and see if your information is current and how you're being taxed. Be careful with that, though. If you are in an area with higher taxes, you could increase your bill.

Taxation is based on use address, not billing. Carriers collect seperate information, there is.your billing address (ex: po box) and your use address (address on your driver liscense).

They only tax your use address. Chances are, the carrier did not update all levels of your account information when changing your billing address.

The same applies to CC payments. Say you buy something with a CC that has a billing zip in Ohio and ship to Caifornia, you will be charged California state tax because the item is being used in CA.

My ph# is area code 203, Connecticut, but my billing address is Las Vegas, Nv. I do intend to move back home sometime in the next 12-14 months though. I'm currently saving money.

The day of area codes being mandated to region is slowly going away. In many cases, as long as you're happy with it, you probably can keep the same phone number for the rest of your life.

I can be reached at four phone numbers with four different area codes....let me tell you something, area codes have become USELESS for determining where a call originated from....
