Nokia Looking for Dismissal of Apple Suit

Nokia has asked the Delaware judge overseeing the lawsuits between Apple and Nokia to toss Apple's claims that Nokia is engaging in monopolistic behavior. Apple says that Nokia is in breach of contract and is demanding unreasonable royalties for wireless patents. Nokia said Apple's allegations are "designed to divert attention away from free-riding off of Nokia’s intellectual property." Nokia also accused Apple of "revisionist history, misleading characterizations, unsupported allegations and flawed and contradictory legal theories to turn these fruitless negotiations into a multi-count federal lawsuit." Nokia indicated that the two companies tried to come to financial terms with some of the patents in question, but in the end were unable to make any agreements. Nokia said that Apple's offers were "unremarkable." Both companies have filed lawsuits against one another and have also appealed to the U.S. International Trade Commission to block the import/export of one another's handsets until the lawsuits are settled. The ITC has said it will begin hearing evidence in October 2010, and it hopes to issue a final ruling by June 2011. The Delaware-based case won't be scheduled for trial until April or May 2012.

Why these patents should be looked at.

The patent department should be investigated for flaws in granting any patent. Being a musician, I can bring up some examples:

George Harrison writes and patents a song "My Sweet Lord". Then gets sued years later for copying a "Patented" song by the Chifons called "He's So Fine".

John Lennon writes and Patents a song "Come Together" and then gets sued for using words and similar patented music by Chuck Barry's "You Can't Catch Me".

I am sure there are other numerous examples in every industry. However, the bottom line of my point is Apple tries to patent finger gesturing as a whole that many have done before. The patent department clearly overlooks the accomplishments of the others and issues patents to Apple that covers too broad ...

Nokia is a pathetic excuse for a phone company

Nokia's filing reads like a Keith Olbermann rant.

Grasping at straws much, Nokia?

"revisionist history, misleading characterizations, unsupported allegations and flawed and contradictory legal theories to turn these fruitless negotiations into a multi-count federal lawsuit."

Number of good Nokia phones nowadays: 0

Number of class leading Nokia smartphones produced in the past 4 years: 0 .

They're an irrelevant company. The sooner they die the better.
How did I know you'd say something like that?

Yes Blue, you say this everytime there is a post about Nokia and/or Apple. We get it. And Nokia is far from irrelevant. Head to Europe, you'll get a far different picture of the smartphone landscap...

Only to you, because you can't read big words apparently (like "characterizations").

Your ignorance is mind numbing blue. Nokia is the largest mobile handset manufacturer in the WORLD. How you can claim they have no intellectual property rights versus the new to the mobile market Apple is beyond comprehension.

Granted, you may del...

I hope they do

I am sick to death of seeing all these lawsuits. They are doing nothing but slowing innovation. At the same time that I understand Apple defending their patents, I also hate them for keeping any other company from using multi-touch capabilities. Maybe I'm reaching here, but if no other companies can use or enable mutli-touch, then we'll have the iPhone, and no other touch screen only devices. Which is crap.
I hate Apple, and I don't hide it. This is yet another reason why. For all their talk about making innovations, they can't stand whenever anyone else does. Find a way to license this tech out to other companies, please! I am sick of reading about 1 lawsuit after another. I look forward to how this company works after the reign...

At least yet.

Their HTC suit is mostly about HTC copying touch screen gestures Apple pioneered.

suing over patent infringement is how business is done. I agree that Apple is attempting to kill innovation in this way, but the real problem is the patent office. If you read the list of patents that Apple is suing both Nokia and HTC each one is so b...

I have a finger gesture for them. Do you think they tried to patent that too?

I have an ipod touch but I assure you that is the last apple product I will ever buy.

keeping to the point...

I hope this gets sorted out quickly. It sounds like both companies decided to shoot first and and questions later when it came to that whole copyright thing.

whatever....

yaaaaay.
Well, I like you a lot better than some others on here. So, that's a start, right? But seriously, on a relevant note, articles like this start to make me wonder how out of touch patent laws are. Again, and I can't reiterate this enough, I thoroughl...
