Judge Scolds Samsung Over Deleted Emails

Federal Judge Paul Grewal has sanctioned Samsung for preventing emails meant to be used as evidence in its patent lawsuit with Apple from being automatically deleted. Samsung automatically deletes all emails more than two weeks old, which it says is a tactic employed to prevent sensitive information from being leaked. Though the company instructed employees to save the emails, Samsung never turned off the automatic deletion system. The sanctions put in place, at Apple's behest, mean that the jury will be told that Samsung failed to preserve evidence for the case, and that it is more likely than not Samsung destroyed the evidence on purpose. The trial is set to commence July 30. In separate filings today, Apple accused Samsung of seeking unfair patent licensing fees for its standards essential patents, amounting to 2.4% of the sales price of each infringing device sold. Apple says Samsung demanded Apple pay a higher fee than Samsung charges other companies to license the same patents.
