FCC To Allow Auction 35 Opt-Outs

The FCC will announce either today or tomorrow an option for bidders to opt out of auction 35, according to sources close to the deal. Auction 35 was the re-sale of spectrum the FCC attempted to reclaim from bankrupt NextWave. The spectrum is currently tied up in a Supreme Court case, making the FCC unable to deliver the spectrum to auction 35 bidders. As one of the largest bidders, Verizon Wireless has been fighting for the FCC to release them from their bid obligations.
