The lawsuits against VZw are mostly because people don't listen, don't read contracts before they sign them and thn get butt hurt when they use more than what their plan allows and they get billed for THEIR USAGE, including downloads & messages. You are past the 15 day satisfaction guarantee that VZW offers on all phones that they sell, so you won't be able to take the 8300 back. You could just buy the new phone on a new line of service and just go with one of VZW's family share plans. If you don't actually need the extra line, you just keep the other phone for a back up in case of loss, theft, or damage.

Vcast capable handsets as of 010106 here are the choices : 2 by samsung, 2 by lg 1 by audiovox (utstarcom) 2 by motorola 7 to start with for the vcast service itself. for VCAST music there will be 3 to start that are able to use that service. the 9800 update later in the year will add to the 3 starter models.

AAC is primarily used by Apple, they chose to go with CINGULAR. That's why VZW went with WMA. At the time that i tunes launched they didn't have all those LEGAL tracks.
