A more realistic analogy is the mcdonalds employee realizes apple is i high roller so they offer them less than what they charge others as a respectful gesture. Then apple gets upset that mcdonalds is charging them anything at all, and says that at most they will pay 1/2 cent for any menu item.

I am familiar the email evidence about iOS features Samsung wanted to incorporate into their phones. Wanting to incorporate features a competitor offers is not a legal test for patentability or patent infringement. There were similar emails from Apple from the development of the original iPhone that indicate that their design was based on phones from Sony. Korea is another lower court ruling which will likely be changed as both companies go through the appeals process. The only patent they found Samsung violated there is for bounceback. Samasung was found guilty of infringing on six patents in California. I think you're implying that since another lower court found Samsung had infringed on a single patent that it somehow validates California, this is not the case. There are already six finished cases that have been appealed ...

No. The law says that you cannot patent something if you didn't invent it. If a claimed invention has been used before or even written about, this is called prior art, which invalidates a claimed patent. Those are the technicalities of the law, at least the main ones involved in this case. All of the patents involved in this trial are for items that have been around much longer than iPhone. Well, the reversal of the Tab ban was actually part of the California trial, the injunction was reversed because the jury found it didn't infirnge. The would be the first reversal of one of the rulings from that trial. The big injunction (up to 28 devices now I think) will be ruled on in December, that ruling is still a part of the California Dist Court, not the court of appeals that reversed this. To my knowlege, this was the only samsung ...

You're completely wrong. The USPTO, only does a very small amount of background research on any patentet application and issues patents all the time that are later invalidated in court. Having a patent issued does not automatically make it valid.

I don't know what was going on in Velvin Hogan's mind, but he's to blame for this whole mess. He convinced the rest of the jury that in order for prior art invalidate a patent it must be "interchangable," but there is no such requirement for prior art. Aparently the rest of the jurors decided to listen to him and not read the judge's instructions. I'm giving Velvin the benifit of the doubt and calling it bull-headed ignorance.

I also want to throw in that the evil empire was found to have fabricated evidence in previous trials. The submitted comparision shots of the iPad and Galaxy Tab, with the Tab altered to have the same aspect ratio is the iPad, which it does not. They also submitted doctored photos of the Galaxy S II as evidence where they changed the sise and modified the homescreen to make it appear more iPhone like. Evil empire? Oh yeah.

You're making two incorrect assumptions here: 1) that the Califonia verdict is final 2) the fact that Samsung wanted to make their phones like iphone means they're guilty. This isn't the way patent law works. If you didn't originate something you can't patent it. You also can patent obvious things. Even if Apple originated a single one of the items in these patents (they didn't) they would have a tough go in court. Think of all the store brand packaging that's clearly ...

Apple has said several times that Samsung is violating their trade dress, but that wasn't part of the California trial. The Patents are: 1) white rectangle with rounded corners (white iPhone) 2) black rectangle with rounded corners (black iPhone) 3) homescreen: “a matrix of colorful square icons with evenly rounded corners” 4) double tap to zoom 5) pinch to zoom 6) bounce back i.e. "thre rubber band" effect. The details of Apple/Microsoft's cross licensing agreement aren't public, but I'd guess that they're very different that the discussions Apple and Samsung have had. What Apple wanted as a licensing agreement from Samsung is ridiculous. Samsung won't have to pay Apple a penny. Samsung has lots of grounds for an appeal, which will be granted if the judge doesn't just throw out the verdict first. If that happens then Apple will appeal. Apple would love it if they could get every one of their competitors to pay liscensing fees for bogus patents they never should have been awarded. For Samsung, agreeing to that would be admitting that Apple is right, when clearly they are not. Also, Apple's figure that they want to pay to license Samsung's patents is $0.0049 per patent per phone. Apple wants Samsung to pay them licensing fees of over $30 per phone. No real surprise that Samsung wouldn't agree to this.

Actually two of the patents the jury found Samsung infringed are about just that. There is no written description in the actual patents, just some basic drawings of the design. The "rectangle with rounded corners" line that everyone is using is actually from Apple's court filings, that's how they described the design of the iPhone and iPad.

It does use internet but they don't bill internet charges for picture messages. If you block internet you lose access to picture messaging.

She's not actually being charged for the picture message, that's included in the texting package. More likely is that she's accidentally connecting to the internet. Some phones are quite bad for this. The last flip phone I had would automatically start connecting to the internet if i pushed the up button from the home screen.

If you did want to report it and your app isn't working you can call customer service and ask them to put in a network incident report for that address. AT&T actually uses that inforation for their network planning and management. It's the exact same thing that mark the spot app does.

They would have to honor the plan during the merger or it would be a material change to your contract. If there is a material change you would be notified in writing and be given 30 days to cancel without penalty. LTE is definately faster for now. I'd like to see how it competes with the 42mbps hspa+ when there are more users on verizon's LTE network. The reason I say neither are 4G is because neither standard is certified IMT-Advanced.

I'd like to see them revised. With the way the technology is advancing 2 gigs is getting smaller every day. My prediction is that we'll see some updates to the data plans immediately preceding the next iphone release. I'm hoping for revised tiers but we'll have to see what happens.

Customer opinions do matter- but not to the point that carriers will use a unsustainable, unprofitable business model to satisfy a market demand. So you can voice your opinion with your $ but this is one that is likely going to fall on deaf ears. Really the people who don't fit on tiered plans are a niche market. Even though many customers want unlimited plans, far fewer need unlimited plans.

It really has very little to do with poor network capacity planning, I think the reason the caps are being put in place is specifically for network capacity planning. Cellular data usage is expected to double every year for some time. Imagine carriers doubling their capacity and doubling their network expenditures every year while revenue is only increasing at 2% - 7%. That's not a business model that's going to work. Streaming audio and video are the killers on those tiered plans. If that stuff is really important for you to do over a cellular network I'd stick with something unlimited. I'm hoping for some revised tiers and family data plans in the soon future. When and if changes like that happen it would likely be at the same time Verizon switches their plans. Which would likely be immediately preceding the release of the new iphone.

Usually even heavier users are fine unless you do streaming audio or video which will eat it up pretty quickly. If you add any wifi networks you may have access to that helps a lot. Also if you adjust the fetch/data sync settings that can also help you be more data efficient. Many aps for social networking or e-mail frequently connect and check for e-mails/status updates etc. How frequently they check is a user adjustable setting. Verizon should ...

I really don't think the rate at which AT&T is deploying LTE has anything to do with them playing possum for the FCC. EDGE is not faster than EVDO. You may be thinking of EDGE. AT&T's EDGE coverage would have been comparable to Verizon's EVDO at the time. All AT&T's 3G sites had been upgraded to HSPA when that commercial ran, so none would have been running UMTS any longer.
